Terms of Use

1. Who provides the app

Sportsmen (“the app”) is provided by Thuyen Nguyen, an individual in Vietnam (“we”, “us”). Contact: sportsmen@apporig.com.

2. Apple’s standard license

The app is licensed to you, not sold. Apple’s Standard End User License Agreement (“Apple EULA”) applies to your use of the app on Apple devices. These terms add to it; if they conflict about the license itself, the Apple EULA prevails. Apple is not a party to these terms, is not responsible for the app or its content, and has no duty to provide support. Apple and its subsidiaries are third-party beneficiaries of the Apple EULA.

3. License and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial training on devices you own or control. You agree not to:

• copy, modify, resell or distribute the app, its art, 3D models, videos or texts;
• reverse engineer or extract the source code, except where the law allows;
• bypass or tamper with purchases, access checks or other protections;
• use the app in a way that is unlawful or that harms others or the services behind it.

4. Health and safety

Sportsmen is not medical advice. The app is a training log and timer. Exercises, goals, levels, rest times, calorie figures (which are only estimates) and Iron’s messages are general information and motivation, not a personal program from a qualified professional.

Exercise has risks of injury. Talk to a doctor before starting or changing a training program, especially if you have a health condition, are pregnant or are returning from an injury. Use proper equipment, warm up, train within your limits, stop at pain, dizziness or shortness of breath, and ask for a spotter when lifting heavy. You exercise at your own risk.

5. Free features and Premium

Part of the app is free: two goals, six exercises and the full five-set workout with rest timers, plus the other free features shown in the app. Premium unlocks all goals, the full exercise catalog with technique videos, circuits and custom workouts, custom exercises, and detailed stats and full history. What is included may be adjusted in updates; we will not remove what you have paid for during the paid period.

6. Auto-renewing subscriptions

Premium is offered as an auto-renewing subscription with these options (US prices; the App Store shows the price and currency for your country, including taxes, before you buy):

• Premium Yearly: 1 year, $39.99 per year, with a 7-day free trial for eligible new subscribers.
• Premium Weekly: 1 week, $4.99 per week, no free trial.

• Payment is charged to your Apple ID account at confirmation of purchase, or when a free trial ends.
• The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price of that plan.
• You can manage or cancel the subscription in iOS Settings → [your name] → Subscriptions after purchase. Deleting the app does not cancel it. Cancellation takes effect at the end of the current paid period, and you keep Premium until then.
• Any unused part of a free trial is forfeited when you buy a subscription.
• If the price changes, Apple will notify you and, where required, ask for your consent; if you do not agree, the subscription ends.
• Refunds are handled by Apple under its policies at reportaproblem.apple.com. We cannot refund App Store payments ourselves. This does not limit rights you have under mandatory consumer law, such as a statutory right of withdrawal, where it applies.

7. Iron skins and restoring purchases

Iron skins are optional one-time purchases (currently $1.99 each in the US, shown in your currency in the store). They change how Iron looks, are separate from Premium, and do not unlock Premium features. Skins are non-consumable: you can restore them on devices signed in to the same Apple ID with Restore Purchases. Purchases are tied to your Apple ID and the store; because the app has no accounts, they do not transfer to a different platform or Apple ID.

8. Your data

Your training data is stored on your device and is yours. We are not able to recover it if you delete the app, reset data or lose the device without a backup. Keep your own backups if the history matters to you. How we handle data is described in the Privacy Policy.

9. Third-party services

The app uses Apple (purchases, Apple Health), Adapty (subscription management) and Google Firebase (anonymous statistics and crash reports). Their own terms apply to their services. The app may include open-source components under their licenses.

10. Intellectual property

The app, including the Iron character, 3D models, animations, illustrations, videos, texts and design, belongs to us or our licensors and is protected by law. These terms give you no ownership rights in them.

11. Warranty disclaimer

To the maximum extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, uninterrupted or error-free operation, or the accuracy of calorie figures. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price where the Apple EULA provides for it; Apple has no other warranty obligation for the app.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, lost data or profits, or for injury or damage resulting from exercises you perform, and our total liability for claims related to the app is limited to the amount you paid us through the App Store in the 12 months before the claim. Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, for fraud, or your mandatory rights as a consumer.

13. Changes and termination

We may update the app and these terms. The version date is shown in the page footer and earlier editions are kept at /legal/<version>/. If a change is material we will tell you in the app; continuing to use the app after that means you accept it. You may stop using the app at any time by deleting it. We may suspend access for a breach of these terms.

14. Governing law

These terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Disputes will be brought to the competent courts of Vietnam, unless mandatory law gives you the right to use the courts of your country of residence or to rely on that country’s consumer protection rules, which are not affected.
